Privacy Policy

1. Age Requirement

The Services are intended solely for adults eighteen (18) years of age or older. You must be at least eighteen (18) years old to create an account or participate in any pool.

We verify age at registration. Our sign-up process requires you to provide your date of birth, and accounts cannot be created by any person whose stated date of birth indicates they are under eighteen (18) years of age.

We do not knowingly collect personal information from anyone under the age of eighteen (18). If we learn that we have collected personal information from a person under eighteen (18), we will delete that information promptly. If you believe a person under eighteen (18) has provided us with personal information, please contact us at admin@poolpartygaming.com.

2. Geographic Scope

The Services are operated and maintained in the United States and are intended for use by residents of the United States. We do not market the Services to, or direct the Services toward, residents of the European Union, the European Economic Area, the United Kingdom, or any other jurisdiction outside the United States.

If you access the Services from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, and you consent to that transfer, storage, and processing.

3. Information We Collect

Information You Provide at Registration.

When you create an account, we collect:

• Your first and last name;
• Your phone number and/or email address (used for one-time passcode authentication and account communications);
• Your date of birth (used to verify that you are at least eighteen (18) years of age); and
• Your ZIP code.

Entry Names.

When you join a pool, you create an entry name for that pool. You may choose any entry name you wish, you may use different entry names in different pools, and you may change your entry name. Entry names are set at the pool level and are not a single persistent username across the Services.

Participation Data.

As you use the Services, we collect information about your participation in pools, including the pools and pool environments you join, the picks and selections you submit, the date and time of your activity, how frequently you participate, whether you joined a pool during an in-venue event, your standings and results, and prizes you have won, claimed, or redeemed.

Prize Fulfillment Information.

If you win a prize that requires physical delivery, we will ask you to provide a mailing address and any other details necessary to fulfill that prize. We collect this information solely for the purpose of delivering the prize you have won.

Information Collected Automatically.

When you use the Services, we automatically collect certain technical information, including your device type and model, operating system and version, app version, unique device identifiers, session activity and in-app behavior, crash and error reports, and Internet Protocol (IP) address. We use this information to operate, secure, maintain, troubleshoot, and improve the Services.

We do not collect precise geolocation data from your device. Where the Services reference your location, that reference is based on the ZIP code you provide at registration, not on device location tracking.

Log Data.

Our servers automatically record certain information generated by your use of the Services, including authentication events, application and function logs, error and crash logs, notification delivery records, and date and time stamps. We retain server log data for approximately ninety (90) days to maintain the security, reliability, and performance of the Services.

Cookies and Similar Technologies (Website Only).

Our Website is a landing page hosted on the Squarespace platform and is used primarily to provide information and direct visitors to download the App. The Website uses functional and analytics cookies provided through the Squarespace platform to operate the site and understand how visitors use it. You may set your browser to refuse or delete cookies, though certain Website features may not function properly as a result. Our Website does not respond to “Do Not Track” browser signals. The App does not use browser cookies.

Analytics.

We may use analytics tools to understand how the Services are used in the aggregate so that we can improve them. If and when analytics are enabled, we expect to use Firebase Analytics, a service provided by Google LLC. Information collected through analytics tools is used for product improvement and is not used to serve you targeted advertising.

4. How We Use Your Information

We use the information we collect to:

• Create, authenticate, and maintain your account;
• Verify that you meet the eighteen (18) year age requirement;
• Operate the Services, including registering your pool entries, recording your picks, calculating standings, and determining results;
• Identify prize winners and facilitate prize notification and fulfillment;
• Send you administrative and transactional communications, such as pick reminders, deadline notices, results, standings updates, prize notifications, and account or security notices;
• Provide the participant data described in Section 5 to the venue or organization hosting a pool you have joined;
• Respond to your questions, requests, and support inquiries;
• Detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms of Service;
• Analyze usage patterns in order to maintain, troubleshoot, and improve the Services;
• Send you promotional communications about the Services, from which you may opt out at any time; and
• Comply with applicable law and enforce our legal rights.

Anonymized and Aggregated Information.

We may create anonymized and aggregated information by removing identifiers so that the information no longer identifies you. Because anonymized and aggregated information does not identify you, we may retain and use it without limitation and may disclose it to third parties.

5. How We Share Your Information

Venues and Organizations Hosting Pools.

The Services allow venues, businesses, and organizations (each a “Hosting Organization”) to host branded sports pools for their customers, members, and communities. When you join a pool hosted by a Hosting Organization, you understand and agree that the following information associated with your participation in that pool is made available to that Hosting Organization:

• Your first and last name;
• Your entry name(s) for that pool;
• Your email address and/or phone number;
• Your ZIP code;
• Your birth year (we do not share your full date of birth); and
• Your participation data for that pool, including pools joined, picks submitted, frequency of participation, whether you joined during an in-venue event, your results and standings, and prizes won, claimed, or redeemed.

This information is provided to the Hosting Organization upon the Hosting Organization’s request. At present, we fulfill these requests manually by delivering the data to the Hosting Organization. We may in the future make self-service export functionality available to Hosting Organizations, allowing them to access this data directly; this Privacy Policy will continue to govern that information regardless of the method by which it is delivered.

Hosting Organizations may use this information for purposes relating to the pool and for their own internal marketing, customer relationship management, and promotional purposes relating to their business. Each Hosting Organization is independently responsible for its own use of the information it receives.

Under our agreements with Hosting Organizations, each Hosting Organization is contractually required to: handle your information in compliance with applicable federal, state, and local privacy laws; maintain reasonable safeguards to protect it; refrain from selling your information or transferring it to any other third party; use it solely for its own business purposes; and honor opt-out and unsubscribe requests you make to them directly. If you no longer wish to receive communications from a Hosting Organization, you should contact that Hosting Organization directly, and you may also contact us for assistance.

Information collected solely for prize fulfillment is treated differently. Mailing addresses and related fulfillment details are provided to a Hosting Organization only as needed to deliver a prize you have won, may not be added to that Hosting Organization’s marketing lists without your separate, explicit consent, and must be deleted by the Hosting Organization following confirmed delivery.

Service Providers.

We share information with third-party service providers who perform services on our behalf and process information under our instructions. These include Google LLC, which provides our authentication, database, server function, and push notification infrastructure through Firebase; and SendGrid, which delivers account, pool, and prize communications to you by email. Service providers are permitted to use your information only to provide services to us and are required to protect it.

Third Parties You Designate.

If you direct us to share your information with a third party, we will share it as you have authorized.

Legal and Safety Disclosures.

We may disclose information if we believe in good faith that disclosure is necessary to: comply with applicable law, legal process, subpoena, or governmental request; cooperate with a legal investigation; enforce our Terms of Service or this Privacy Policy; protect or defend the rights, property, or safety of Pool Party Gaming, our users, or the public; or investigate or prevent suspected fraud or unlawful activity.

Business Transfers.

If we are involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, your information may be transferred as part of that transaction. We will require any acquiring party to honor the commitments made in this Privacy Policy with respect to information transferred, or we will provide you with notice and an opportunity to delete your information.

We Do Not Sell Your Personal Information.

We do not sell your personal information, and we have not sold personal information in the preceding twelve (12) months.

We Do Not Share Your Information for Cross-Context Behavioral Advertising.

We do not share your personal information with advertisers, advertising networks, data brokers, or ad exchanges. We do not use your information for targeted or interest-based advertising, and we do not track your activity across other companies’ apps or websites for advertising purposes.

6. Push Notifications, Email, and Text Messages

Push Notifications.

With your permission, we send push notifications through the App to deliver pick reminders, deadline notices, results and standings updates, prize notifications, and account or security messages. You may turn push notifications on or off at any time through your device settings. Push notifications operate as a single category; if you disable push notifications, you will stop receiving all push notifications from the App.

Email.

We send email communications relating to your account and pool activity, including account creation, pool participation, weekly recaps, and pick reminders. These emails include an unsubscribe link, and you may opt out of them at any time. Prize notifications and other transactional messages necessary to deliver a prize you have won are sent as a separate category and are not affected by unsubscribing from general account and pool emails. Certain messages necessary to provide the Services, such as account verification and security messages and notices regarding changes to our Terms of Service or this Privacy Policy, are also sent regardless of your general email preferences.

Text Messages.

We use text messages only to deliver one-time passcodes for signing in to your account. We do not currently send promotional or marketing text messages. Standard message and data rates from your carrier may apply.

7. How Long We Keep Your Information

We retain your personal information for as long as your account remains active and for as long as necessary to provide the Services to you.

If you delete your account, or if your account becomes inactive, we will delete or anonymize your personal information within twelve (12) months, except where we are required or permitted to retain it as described below.

We may retain certain information for longer periods where necessary to: comply with our legal, tax, accounting, and recordkeeping obligations; establish, exercise, or defend legal claims; detect and prevent fraud, abuse, or security incidents; or enforce our Terms of Service. Server log data is retained for approximately ninety (90) days. Anonymized and aggregated information, which does not identify you, may be retained indefinitely.

Information that a Hosting Organization has already received is subject to that Hosting Organization’s own retention practices and privacy obligations. If you wish to have your information deleted from a Hosting Organization’s records, you should contact that Hosting Organization directly.

8. Your Privacy Rights

Depending on your state of residence, you may have specific rights regarding your personal information under applicable state privacy laws. We honor the rights described below for residents of states where such laws apply, and as a matter of practice we make these rights available to all users of the Services.

Right to Know and Access.

You may request confirmation of whether we process your personal information and request access to that information, including the categories we collect, the sources from which we collect it, our purposes for collecting it, the categories of third parties with whom we share it, and the specific pieces of personal information we hold about you.

Right to Delete.

You may request that we delete your personal information, and you may delete your account at any time. Upon receiving and verifying your request, we will delete your personal information from our records and direct our service providers to do the same, except where retention is required or permitted as described in Section 7.

Right to Correct.

You may request that we correct inaccurate personal information that we maintain about you. You may also update much of your account information directly within the App.

Right to Opt Out of Sale or Sharing.

You have the right to opt out of the sale of your personal information and of sharing your personal information for cross-context behavioral advertising. As described in Section 5, we do not engage in either practice, so there is nothing for you to opt out of. Separately, you may opt out of promotional communications at any time as described in Section 6.

Right to Non-Discrimination.

We will not discriminate against you for exercising any of your privacy rights.

How to Delete Your Account.

You may delete your account and your associated personal information at any time directly within the App. The in-app deletion is immediate: when you confirm deletion in the App, your account and associated personal information are deleted, subject only to information we are required or permitted to retain as described in Section 7.

You may also request account and data deletion through our Website at poolpartygaming.com without logging in to the App. Website deletion requests are processed within thirty (30) days of receipt. To submit a Website request, follow the account deletion instructions provided on the Website or email us at admin@poolpartygaming.com.

How to Exercise Your Other Rights.

To exercise any of the other rights described in this Section, contact us at admin@poolpartygaming.com. We will need to verify your identity before fulfilling your request. We will respond to your request within forty-five (45) days, and will notify you if we require additional time as permitted by applicable law. You may use an authorized agent to submit a request on your behalf, subject to verification. We do not charge a fee to process a verifiable request unless it is excessive, repetitive, or unfounded.

California Residents.

If you are a California resident and have an established business relationship with us, you may request a notice identifying the categories of personal information we have shared with third parties for those third parties’ direct marketing purposes during the preceding calendar year. 9. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, disclosure, alteration, and destruction. These measures include passwordless authentication through one-time passcodes, encryption of data in transit, access controls limiting who may access personal information, and use of established infrastructure providers.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of the device and the phone number or email address associated with your account. If you believe your account has been compromised, contact us immediately at admin@poolpartygaming.com.

10. Third-Party Websites and Services

The Services may contain links to websites or services operated by third parties, including Hosting Organizations. We do not control and are not responsible for the privacy practices or content of those third parties. This Privacy Policy does not apply to information collected by any third party. We encourage you to review the privacy policy of any third-party website or service you visit.

11. Beta Platform Notice

The Services are in active development. Features, functionality, and the categories of information we collect may change as the platform evolves. If we make material changes to how we handle your personal information, we will update this Privacy Policy and notify you as described in Section 13.

12. Promotional Contests

Pool Party Gaming operates the Services as a free-to-enter promotional contest platform. Participation in pools does not require any purchase, entry fee, wager, or other consideration. Prizes are provided by the Hosting Organization or by Pool Party Gaming as applicable, and no consideration is exchanged for the opportunity to win. The Services are not a gambling, sports betting, or paid fantasy sports platform.

13. Changes to This Privacy Policy

We may revise this Privacy Policy from time to time. If we make material changes to how we use or share your personal information, we will notify you by sending an email to the address associated with your account, by displaying a notice within the App, or both, and we will update the “Last Updated” date above.

Material changes will become effective thirty (30) calendar days after the earlier of our sending email notice or posting notice within the App, unless a shorter period is required by law. If you do not agree to a change, you may delete your account before the change takes effect. Continued use of the Services after a change becomes effective indicates your acceptance of the revised Privacy Policy.
